Legal Limits of Parental Discipline: A Case of Reasonable Force

Case Description: This case examines the legality of using physical discipline on a child. The client, previously warned by the Children’s Aid Society, disciplined his son after a misbehavior incident. He allegedly slapped his son twice on the thigh and once on the head. Bruising appeared days later, and the client’s wife reported it to police. The client denied hitting his son’s head and said the bruising was caused by neighborhood play. East Law argued under s.43 of the Criminal Code, which allows reasonable physical discipline for corrective purposes if not driven by frustration. Cross-examination confirmed other children may have caused the bruising.

Solution: The client was acquitted.

Presence Isn’t Guilt: A Case of Attempted Murder

Case Description: This case shows that being at a crime scene does not mean guilt. The client was charged with Attempted Murder after a robbery at a marijuana grow-op. Surveillance showed him at Walmart with a friend buying masks, though he wasn’t seen handling them. That night, the client and two others approached the grow-op on foot. During the break-in, the homeowner confronted the assailants and was shot. The client’s vehicle was later stopped by police, who found masks and gloves. Another vehicle used by other assailants was never found. At the hearing, East Law revealed the masks weren’t used in the crime, and the victim’s memory was influenced by police. With no DNA evidence or proof of the client’s role, East Law argued that mere presence wasn’t enough to prove guilt.

Solution: The court agreed, and the client was acquitted.
